Please read these Terms and Conditions carefully. These Terms and Conditions include your rights, obligations, restrictions and our policy for acceptable use of the Omnia Models Website.

By accessing and then using this website, you accept, without limitation or qualification, the following Terms and Conditions that govern all of its members and website users. You are only authorized to use the Omnia Models Website and its services if you agree to abide by all applicable laws and to these Terms and Conditions. You also agreed to this contract between you, the Member, OmniaModels.com and Omnia Communications when you clicked the "I agree" checkbox during signup or if you are a user or non-member just browsing OmniaModels.com.
If you do NOT ACCEPT the OM Terms and Conditions, then please discontinue your use of the OM Website.
 
We may modify these Terms and Conditions from time to time and such modification shall be effective upon posting that on the website. You agree to be bound to any changes to these Terms and Conditions when you use the OM Website after any such modification is posted. It is important that you review these Terms and Conditions regularly to ensure you are updated as to any changes made. OmniaModels.com is a public access general purpose portfolio hosting website and community for Models, Industry Pro and Fan Members. And it is also a fashion industry-specific networking website intended for all those people interested in the fashion world who want to network, to communicate and to offer assignment based projects.
 
OmniaModels.com is not intended for users under the age of 18. So if you are not 18 years old you cannot submit a portfolio or any personal information.
 
Without limiting any other provisions of this Agreement, you may not use this website for any purpose that is unlawful or prohibited by this Agreement and/or any applicable additional terms. Your access to this website may be terminated immediately in our sole discretion, with or without notice, if you fail to comply with any provision of this agreement and/or additional terms, including the OM Website's rules, or for any other reason, or no reason.
You expressly agree not to:
-          Act as an agent, affiliate or representative of the site and utilize this website or its contents for any commercial purpose other than for which the site is intended without express written permission from the Omnia Model Website;
-          Access, monitor or copy any content or information of this Website using any robot, spider, scraper or other automated means or any manual process for any purpose without our express written permission;
-          Take any action that imposes, or may impose, in our discretion, an unreasonable or disproportionate burden on our infrastructure;
-          "frame," "mirror" or otherwise incorporate any part of this website into any other website without our prior written permission.

And not to have the following behaviors:
-          Strong, vulgar, obscene or otherwise harmful language;
-          Racially, ethnically or otherwise, objectionable language;
-          Harassing, intimidating, stalking or threatening other community members;
-          Libelous, defamatory or otherwise tortuous language;
-          Online vandalism;
-          Impersonation of another person;
-          Posting, distributing, transmitting or promoting illegal content;
-          Invasion of another's privacy;
-          Actions that are hurtful to minors;
-          Posting, providing, transmitting or otherwise making available any materials or information infringing on the rights of a third party;
-          Posting, providing, transmitting or otherwise making available any junk mail or spam;
-          Posting, uploading, emailing or otherwise transmitting any material that contains any malicious computer code, or reverse engineering or hacking any materials on the website.
 
Use of anonymizing services or software is prohibited when accessing any Omnia Models server or property. Use of any anonymizer software, networks, or websites to access OmniaModels.com may lead to the loss of services or your OM Account without warning or refund.
 
We will fully cooperate with any law enforcement authorities or court order requesting or directing the website to disclose the identity of anyone posting any such information or materials.
 
THE SERVICE AND THE SITES ARE PROVIDED ON AN "AS IS" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF TITLE OR IMPLIED WARRANTIES OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE, OTHER THAN THOSE WARRANTIES WHICH ARE IMPOSED BY AND INCAPABLE OF EXCLUSION, RESTRICTION OR MODIFICATION UNDER THE LAWS APPLICABLE TO THIS AGREEMENT.
NEITHER OMNIAMODELS.COM AND OMNIA COMMUNICATIONS, NOR ANY OF ITS SUBSIDIARIES, DIVISIONS, AFFILIATES, AGENTS, REPRESENTATIVES AND LICENSORS SHALL BE LIABLE TO YOU OR ANYONE ELSE FOR ANY LOSS OR INJURY OR ANY DIRECT, INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, PUNITIVE OR SIMILAR DAMAGES ARISING OUT OF YOUR INABILITY TO ACCESS OR USE, THE SERVICE AND THE WEBSITE, DUE TO THE INSTANT-ACCESS NATURE OF THE OMNIA MODELS WEB SITE AND SERVICES.
 
Members are entirely responsible for any and all activities which occur under their account whether authorized or not authorized. Member agrees to notify OmniaModels.com of any unauthorized use of Member's Account or any other breach of security known or should be known to the Member. Member's right to use the service is personal to the Member. Member agrees not to resell or make any commercial use of the service without the express written consent of OmniaModels.com.
 
We reserve the right to refuse a sign up, registration, subscription which we may judge as unfit due to content or other. This includes, but is not limited by, a profile containing adult oriented material such as pornography, profiles which promote hatred towards persons belonging to any ethnic group, religion or sexual orientation and profiles which infringe copyright or are contrary to Italian and International laws.
 
Members are not permitted to promote or advertise in any way activities that involve sexual contacts. In addition the Members are also not permitted to promote or advertise for work that includes sexual contact between male and female; whether clothed or un-clothed. Members who engage in these styles of work or activities will have their profile cancelled immediately.
 
The acceptance of a sign up, registration, subscription shall be deemed as a contractual agreement between the Member, OmniaModels.com and Omnia Communications.
 
 
Because of the immediate access nature of the internet, we have a no-refund policy, since the member gets immediate and full access to the OM Website and its services and/or products. Since you cannot physically return an e-book or the member services of an online portfolio, we do not give refunds.
If at any point a customer wishes to cancel their sign up, profile, subscription, they may do so but will not be refunded.
 
OmniaModels.com and Omnia Communications will not be responsibles for refunding any PayPal Payments or Withdraws. It is the responsibility of the user to cancel future payments in their PayPal Account as per instructions posted.
You hereby waive any and all claims against PayPal, Omniamodels.com and Omnia Communications and their Subsidiaries, Divisions, Affiliates, Agents, Representatives and Licensors for payments and/or compensation claims arising out of your use of the service and the websites and the information available thereof.
 
 
OmniaModels.com and Omnia Communications have guidelines regarding posting of appropriate images, email addresses, contents and links. You agree to read and adhere to the guidelines as posted throughout the OM Website. Your use of the Service and the OM Website is at your own risk.

OmniaModels.com and Omnia Communications and its affiliates reserve the right, at their sole discretion and without notice, to edit, refuse to post, or remove any material, links, email accounts, images, and content submitted to, or posted on the profiles, messages or portfolios. OmniaModels.com and Omnia Communications and its affiliates reserve the right, in their sole discretion, to deny access to the e-mail systems provided for general community use.
 
Much of the content of this website is owned by individual members of the community and therefore you may NOT modify, copy, reproduce, republish, upload, post, transmit, publicly display, prepare derivative works based on, or distribute in any way any material belonging to the website or its members, including but not limited to text, photos, audios, videos, codes and softwares. OmniaModels.com and Omnia Communications has a stated policy regarding the posting of sexually explicit images to its web pages. Sexually explicit images are not permitted on this website. Failure to adhere to this restriction will result in the removal of the images, and the disablement of that member portfolio. Consistent misclassification (rating) or categorization of images may result in the forced setting of ratings and in gross violations may result in the removal of your portfolio.
PLEASE NOTE: If you produce visual depictions of human beings engaged in sexually-explicit conduct, you may be subject to the name-and age-verification, recordkeeping, and labeling requirements
 
When you post content to the OM Website, you authorize and direct us to make such copies thereof as we deem necessary in order to facilitate the posting and storage of the content on the website. Through the action of posting such content (images, text, videos, etc) you are also granting the OM Website a non-exclusive worldwide license to use, copy, publicly display, publicly perform, reformat, translate such User content (in whole or in part) and distribute such content in connection with operation of the OM Website. This limited license does not grant OmniaModels.com and Omnia Communications the right to sell or otherwise distribute your Content outside of the OmniaModels.com Services without the express permission of the rights holder(s).
 
You may remove your Member Content from the OM Website at any time. If you choose to remove your Member Content, the license granted above will automatically expire, however you acknowledge that the Company may retain archived copies of your Member Content. This website does not assert any ownership over your Member Content; rather, as between us and you, subject to the rights granted to us in these Terms, you retain full ownership of all of your Member Content and any intellectual property rights or other proprietary rights associated with your Member Content.
 
You should be aware that if you voluntarily disclose personal information (e.g. name, last name, user name, password, email accounts, current address, telephone numbers, etc…) on a profile, messaging system and other, that information can be collected and used by others and may result in unsolicited messages from other parties, and that shall therefore be the sole responsibility and liability of the poster.
 
Therefore, if you have concerns about any of the content of the OM Website you should contact us by selecting the “report abuse” button. The relevant content may be removed from the OM Website.

You agree to not post URLs and other web links in any form, into your personal home page section, or the main portfolio page as links that lead to ADULT SITES or Pay Sites. OmniaModels.com and Omnia Communications reserve the right to remove from its sites any references or portfolios containing Adult Sites or Pay Sites without notice.
 
Additionally certain links to sites, as determined from time to time by OmniaModels.com and Omnia Communications, or the use of links and web addresses, or the use of html formatting and scripting in certain portfolio types, may not be permitted within the portfolio or as an acceptable use of the personal home page link or as portfolio content.
OmniaModels.com and Omnia Communications is under no obligation to provide exposure to competing websites through links or other methods in portfolio and may remove those at them discretion, and without notice.
 
The OmniaModels.com and Omnia Communications referral system is intended for job offers and general inquires related to or leading to work or further discovery. Promotion of services and goods is not an appropriate use of the referral system. OmniaModels.com and Omnia Communications permit one main member portfolio per person.
OmniaModels.com and Omnia Communications does not support bandwidth theft, the linking of images from OmniaModels.com to other websites, or the misuse of links from other websites to OmniaModels.com. Anyone found linking images from OmniaModels.com to other websites, copying contents from OmniaModels.com, or inappropriately linking to OmniaModels.com (to increase their views - through use of hidden frames, or using programs to artificially raise page views, etc.) will result in permanent REMOVAL from OmniaModels.com without notification and may necessitate the notification of the appropriate State and/or Federal authorities.
 
 
No member's e-mail address is made public through the member messages, if an e-mail is posted in the member message it is done so without the approval of OmniaModels.com and Omnia Communications and against the messaging policies. Any acceptance, correspondence or agreement is solely the member's and recipient's responsibility. OmniaModels.com and Omnia Communications nor its Subsidiaries, Divisions, Affiliates, Agents, Representatives or Licensors make no representation as to the legitimacy of any agency and they shall not be liable to anyone for any loss, injury, direct or indirect, incidental, consequential, special, punitive, or similar damages arising from information received or sent, either directly or indirectly through the member messages.
 
OmniaModels.com provides message forwarding and web-based email services in addition to an internal email/messaging/referral system for communication between members. The system is intended for sending specific communications regarding assignments and for communications supporting work between our members. As a member of OmniaModels.com, you will receive occasional emails from OmniaModels.com, including regular email updates, and you may also be contacted by other members seeking to contact or work with you. As new features or member programs and promotions are developed and launched, you will be informed via the postings news to the site and also eventually by email. However, if for any reason we receive a report or information that you have in any way blocked or prevented receipt of emails from us, OmniaModels.com shall have the right, in its absolute discretion, to disable and cancel your account immediately and to retain any monies paid by you for use of the OM Website. If such action occurs and you believe it to be in error, you should contact us immediately and alert the ISP that controls your email account. Separately, when email is sent to an undeliverable email address, your portfolio will be disabled as well. If you discover that your portfolio has been disabled because of outdated contact information, you may provide us with the correct information and we will re-activate your portfolio.
 
 
"Managed portfolios" are accounts in which especially a model portfolio is controlled by a third-party (someone who is not the model or the member). Managed portfolios are permitted on OmniaModels.com under the following circumstances:
-          A singular model/talent portfolio that is maintained by the administrative assistant (in many cases a relative) to the model. In such cases, the model is still responsible for the use of the portfolio, including any actions taken by that assistant;
-          The portfolio is maintained by a legitimate manager or agent who also has an approved portfolio on OmniaModels.com;
-          Managers/Agents who maintain "managed portfolios" for models on OM must keep their management portfolio in good standing. Removal of the "Main" or Management account may result in the removal of any "managed portfolio";
-          Managers/Agents who maintain portfolios for models must also have third-party usage rights (in writing from the photographer) to post any photography of that model on OM Website. Managers, agents, and photographers who have been authorized to post on behalf of their clients may control Model/Talents portfolios in addition to their manager, agent or photographer portfolio.
 
You will be responsible for:
-          Any claim by any third party that the use of the OM Website by you is defamatory, offensive or abusive, or of an obscene or pornographic nature, or is illegal or constitutes a breach of any applicable law, regulation or code of practice;
-          Any claim by any third party that the use of the OM Website by you infringes that third party's copyright or other intellectual property rights of whatever nature;
-          Any fines or penalties imposed by any regulatory, advertising or trading body or authority in connection with the use of the OM Website by you;
-          Our losses and costs resulting from your breach of these OM Community Sites Terms and Conditions.
 
"Managed portfolios" that have not been updated in over 1 (one) year are subject to removal from OmniaModels.com without warning.
 
OmniaModels.com and Omnia Communications make no representations as to the validity of any opinion, advice, information or statement displayed on the messaging system by third parties. You are the sole responsible for the content of your messages and the views expressed by individuals do not represent the views of Omnia Communications and OmniaModels.com.
 
 
It is against OmniaModels.com and Omnia Communications policy to allow competitor portfolio sites to solicit OmniaModels.com members from an account at OmniaModels.com. Any competing portfolio site or online agency site that signs up at OmniaModels.com and then actively solicits OmniaModels.com members to join their competing website or online agency, could have their account deactivated at OmniaModels.com and Omnia Communications discretion, and without any refund.
 
The Promotion and Recruitment of Escorts, Escort Services, Personal Companions, (etc.) are contrary to the purposes of OmniaModels.com website, and will not be tolerated in any way. Soliciting for, recruiting, or offering the services of escorts on this site is strictly prohibited. Portfolios that are used for the solicitation or promotion of escort services in ANY way will be immediately disabled with no refund.
This includes (but is not limited to) the use of the referral system, hyperlinks to external sites promoting escorts, URLs (web addresses) promoting escorts and any other activity that the staff of OmniaModels.com deems as solicitations, promotions or offers.
 
The services provided by the OmniaModels.com site do not include the provision of computer or other necessary equipment to access the OmniaModels.com site. To use the OmniaModels.com site you will require Internet connectivity and appropriate telecommunication links. We shall not be liable for any telephone or other costs that you may incur.
Although Omnia Models aims to offer you the best service possible, OmniaModels.com and Omnia Communications make no promise that the services at the Omnia Models website will meet your requirements. Omnia Models and Omnia Communications cannot guarantee that the service will be fault free. If a fault occurs in the service you should report it to us by the Contact Us page and we will attempt to correct the fault as soon as we reasonably can.
Your access to the OmniaModels.com site may be occasionally restricted to allow for repairs, maintenance or the introduction of new facilities or services. Omnia Models will attempt to restore the service a soon as it reasonably can.
The OmniaModels.com site is provided by Omnia Communications without any warranties or guarantees. You must bear the risks associated with the use of the Internet.
